Ex parto) To legitimate children and change their names.

Be it remembered that on this the 8th day of January 1885 the following petition was presented to Court viz,

To the Worshipful Court of Blount County, Tennessee,
Your petitioner Samuel C. Flanagin, a citizen of Blount county, Tennessee, would respectfully represent unto your Worshipful Court, that since about the year 1864 until the year 187 , he cohabited with one Sarepta Brakebill during which latter year she died- - - said cohabitation was not continuous and openly but surreptitious--and the result of which was the birth of five several children, who were named respectively, Samuel Wiley, Walter Baxter, Chester, Sarepta Ann, and Houston Brakebill, and they are now known by said names. Y o u r petitioner verily believes that they are his own children, and they feel very near to him. At the death of their mother, the said Sarepta Brakebill, your petitioner removed the said children to his own home and has ever since cared and provided for them in as ample manner as he did for his own legitipnate children.

The premises considered, petitioner prays that, by decree of your Worshipful Court, the said Samuel Wiley, Walter Baxter, Chester, Sarepta Ann, and Houston Brakebill be declared to be legitimate children and heirs of petitioner, with all the rights and privileges of legitimate children and that their names be changed from Brakebill to Flanagin, so that they may hereafter have the names, respectively, of Samuel Wiley Flanagin, Walter Baxter Flanagin, Chester Flanagin, Sarepta Ann Flanagin, and Houston Flanagin.

And the Court being of the opinion that the prayer of the petitioner should be granted, the Court is pleased to so decree, and to order and adjudge that the said Samuel Wiley, Walter Baxter, Chester, Sarepta Ann and Houston Brakebill, mentioned in the petition, be, and are hereby rendered legitimate children of petitioner, Samuel C. Flanagin, and that said children be clothed with all the rights and privileges of legitimate children to the said Samuel C. Flanagin, with capacity to inherit and suceed to the real and personal estate of the said Samuel C. Flanagin as heirs, and the Court further orders and decrees that the names of the said children be changed to that of Flanagin as prayed for in the petition.
